Modification of toll review periods
The Official Gazette No 233 published on 25 September 2010 a Royal Decree 1202/2010 of 24 September, which laid down the periods to review tolls that access the transport and distribution of electricity networks. The most important features of this Decree are as follows:
Update of electricity prices:
On 30.06.2010 the Order and CTI/1732/2010 of 28 June has been published in the Official Gazette N. 158, establishing the price of power and energy terms, the rates of access for deliveries made to voltages not exceeding 1 kV and those which have contracted less power than or equal to 10 kW and 2.0A and 2.0ADH, which shall be:
- Power Billing Term: TPA: € 16.633129 / kW / year.
- Active energy Billing Term: TEA: € 0.055479 per kWh.
Also, after 1 July, 2010 access charges for powers above 10 kW as aforementioned shall remain, keeping the CTI/3519/2009 of 28 December in force.
Moreover, the resolution of 28 June, 2010, the Directorate General for Energy and Mines, corrected by the Official Gazette N. 165 of 8 July 2008, which laid down the production cost of electricity and the last resort rates to be applied in the third quarter of 2010, states the terms of power and energy of the last resort rates applicable during the third quarter of 2010, setting the following values:
- Demand Charge: TPU = € 20.633129 / kWh and year
- Unit Electricity cost: TEU mode without time discrimination: TEU0 = € 0.11775 / kWh.
Time discrimination mode, Unit electricity cost:
-TEU1 = € 0.138343 / kWh
-TEU2 = € 0.060736 / kWh
Disappearance of regulated low voltage:
As published in BOE No. 151, dated 23-06-09, under Order ITC/1659/2009, issued on 22 June, the regulated tariffs for low voltage disappear as from 01-07-09 and a quarterly surcharge of 5% will be applied to supplies billed under tariffs 3.0.1 and 3.0.2 that have not been liberalised.
Forecast disappearance of low voltage supplies in the regulated market
Although there is nothing official, there are speculations regarding the disappearance of the regulated market as from 1 July 2009. This will mean that after this date, those supplies that have not processed their changeover to the liberalised market will have to apply the last resort tariff. As occurred with the high voltage tariffs, this tariff will almost certainly not only be particularly expensive, but it may also be subject to monthly increases.
Tariff updates for 2009
The last update published in the BOE, dated 31 December 2008, regulates the tariffs to be applied in the Spanish electricity market as from 1 January 2009. It introduces both significant structural changes and notable price rises for all tariffs in general and in particular as regards access tariffs. There are changes in structure and time bands for both low voltage and high voltage energy.
Disappearance of regulated high voltage
According to that published in BOE dated 28 June 2008, all the high voltage regulated tariffs disappear as from 01/07/08, meaning that as from this date all supplies that apply said tariffs are obliged to operate in the liberalised market; otherwise, the low voltage tariff will be applied to them (approximately 15% more expensive), plus an accumulated monthly surcharge of 5%.
